Check the executed contract before assuming an exemption

For a Texas rural-home purchase using a TREC contract, have the transaction adviser review the actual water-disclosure clause separately from the general seller-disclosure requirement. TREC’s August2026 guidance says the water disclosure is contractual rather than independently required by another law. An exception from the general Seller’s Disclosure Notice does not necessarily establish an exception from this water document.

The reviewed Seller’s Disclosure About Groundwater and Surface Water Rights is Form61-0, effective July1,2026. The reviewed One to Four Family Residential Contract is Form20-19 with the same effective date. Confirm the actual executed form, amendments and transaction type. The residential resale form is not for farm-and-ranch, condominium or builder-new-home transactions; a rural address alone does not settle which form applies.

Keep three water questions separate

The first question is whether the actual contract calls for the water disclosure and what its delivery status is. The second is what the seller states they know about wells, water sources and interests. The third is whether the buyer will obtain the intended rights and adequate physical supply. Completing the first two does not automatically answer the third.

Form61-0 expressly frames its information as seller knowledge as of signing, not a warranty or a substitute for inspections. Its notices direct parties to qualified legal review for water-right questions. Treat the signed document as a source of questions and record references, not a title opinion, pumping test, water-quality result or promise of a future drilling approval.

Review the whole exception, not a single feature

The reviewed20-19 contract sets out an all-conditions exception in Paragraph7I. It addresses seller awareness of wells and specified water features or interests, together with the stated source of the property’s water. TREC explains that being inside a groundwater or subsidence district does not by itself defeat the exception if all of its actual statements are true. Nor does one reassuring statement prove the entire exception.

Have the adviser examine the actual selected provision and required completed information. Give the adviser conflicting records or a known well instead of trying to choose a box from this article. TREC notes uncertainty in some ordinary feature terms and says it cannot decide a specific transaction. This guide supplies no filled form, deadline calculation, termination instruction or automatic refund conclusion.

Read the delivered document with its attachments

Match the supplied document to the exact property and preserve every page and attachment. Record the delivered version and date for the adviser’s review. A blank official form demonstrates the questions the document asks, not the answers for your transaction. An emailed first page should not be treated as a complete reviewed record when the remaining questions or explanations are absent.

Use the well questions to find records, not infer capacity

The form separates known wells, their use and identified registrations or permits. It also asks about ownership or operation benefiting different parties and water received from a well on another property. These distinctions can reveal which agreements and records need follow-up. They do not establish that the seller’s count is exhaustive or that every known well is usable, safe or legally available for the buyer’s plans.

The groundwater-district guide addresses the separate authorization review. Ask the responsible authority about the actual parcel and well, and arrange appropriate qualified condition or supply assessment. Do not open a cap, enter a well structure or run an improvised pumping test to fill a disclosure answer.

Send off-parcel and severed-interest questions to the right reviewer

If the disclosure identifies off-parcel supply, shared operation, leased groundwater or severed interests, obtain the actual referenced agreements and instruments through the transaction professionals. Ask qualified counsel how the documents relate to the property and intended buyer use. A visible pipe, an owner’s past practice or an informal explanation does not replace review of the actual interest and access arrangement.

Preserve unanswered or conflicting identifiers without rewriting the seller’s statement. The disclosure warns that sellers may not have complete knowledge or understanding of the relevant rights and that others may hold related interests. That is a reason for an appropriate examination, not a conclusion that a seller is concealing information or that a particular right necessarily transfers with the land.

Do not convert a pond or permit number into a water-right guarantee

The form distinguishes surface-water-right information from the presence of a pond, lake or water tank. Ask the adviser to connect any stated permit, filing or adjudication reference to the actual records and proposed conveyance. The existence of a water feature alone does not decide the legal source of a right or its suitability for the buyer’s intended use.

Avoid using a generic disclosure definition as an instruction to divert, impound or withdraw water. Regulatory, title and physical-supply questions require their own qualified review. This article does not determine an exemption, approve a water use, predict future water availability or provide a tax or permit calculation. Keep those unresolved tasks visible even after a signed disclosure is received.

Coordinate receipt and follow-up without inventing extra time

Give the adviser the actual contract, receipt information, missing attachments and material questions promptly. Ask how the relevant disclosure provision interacts with the executed agreement and any accepted amendment. The inspection timing guide concerns specialist reports separately; receipt of a disclosure does not itself complete the technical assessment.

Keep a record of requested explanations, delivered corrections and professional conclusions. Do not assume that an unanswered inquiry extends a date, that a revised document resets every deadline or that a verbal assurance supplies the required acceptance. Close each track using the evidence it actually needs rather than mark the whole water review complete because an attachment arrived.

Illustrative scenario: the general disclosure and water document differ

Imagine a buyer is told that a Texas seller is exempt from a general condition disclosure, while the contract file contains a separate water-disclosure provision and records identifying a well. This is an illustrative scenario, not a legal determination about a transaction we examined. The buyer supplies the documents to the adviser rather than assume the first exemption resolves the second requirement.

The adviser checks the actual form and clause, while qualified specialists examine the identified records and physical-supply questions. A delivered seller-knowledge document remains distinct from those findings. The example predicts no requirement, remedy or closing result for a particular buyer; it demonstrates why exemption, receipt, rights and performance should not be collapsed into one label.
